You must be at least 18 years old to create an account. By using the Service, you represent that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. Notify us immediately at {{SUPPORT_CONTACT_EMAIL}} if you suspect unauthorized access.

4. SMS Messaging Terms

By providing your mobile phone number to the Service and consenting to SMS at signup or via subsequent action by your tenant Account Owner, you agree to receive transactional SMS messages from Philo Home Concierge.

4.1 Frequency

Message frequency varies. Typical users receive between 1 and 20 messages per week.

4.2 Carrier Rates

Standard message and data rates may apply, charged by your wireless carrier. We do not charge you separately for SMS.

4.3 Opt-Out

Reply STOP to any message to unsubscribe. We will send a final confirmation and cease SMS to your number. You may continue to use the Service via the dashboard.

4.5 Supported Carriers

We support all major US carriers. We are not liable for messages that fail to deliver due to carrier issues, your device, or your account status with your carrier.

6. User Content

You retain ownership of content you submit to the Service (messages, photos, documents, notes). By submitting content, you grant us a non-exclusive, worldwide license to use, store, process, and transmit that content as necessary to operate the Service for you and your tenant.

You are responsible for ensuring you have the right to share any content you submit.

7. Privacy

Our collection, use, and protection of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Subscriptions and Billing

Tenant subscriptions are billed via Stripe. Subscription terms (price, billing frequency, plan features) are presented at signup and may be modified with 30 days' notice. Refunds are governed by the refund policy in effect at the time of purchase.

Individual users (Account Owners, Property Leads, Team Members) within a paying tenant generally do not pay separately — the tenant subscription covers the user accounts within that tenant.

9. Service Availability

We make commercially reasonable efforts to keep the Service available 24/7 but do not guarantee uninterrupted access. We may schedule maintenance windows, may experience outages outside our control, and may make changes to the Service from time to time.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The AI agent ("Philo") provides automated assistance. Outputs may be incorrect. You are responsible for reviewing AI-generated content (quotes, approvals, communications) before relying on it for material decisions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ITAM ATELIER INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOUR TENANT PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless ITAM Atelier Inc., its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the Service.

13. Termination

You may terminate your account at any time by contacting your tenant Account Owner or {{SUPPORT_CONTACT_EMAIL}}. We may terminate or suspend your access for violation of these Terms or non-payment.

Upon termination, your right to use the Service ends. Provisions that by their nature survive termination (privacy, liability limitations, governing law) will continue in effect.

14. Governing Law and Dispute Resolution
